District Court Denies KPMG's Motion to Dismiss Attorneys' Fees Lawsuit

In United States v. Stein, Nos. S1-05 Crim. 0888, 06 Civ. 5007 (S.D.N.Y. 9/6/06), Judge Lewis Kaplan of the U.S. District Court for the Southern District of New York denied KPMG's motion to dismiss a lawsuit brought by 16 former employees demanding that the firm pay their attorneys' fees in the criminal tax shelter case.  He refused to send the fee dispute to arbitration and set the trial for October 17.
